1. About These Terms
These Terms of Service ("Terms") govern your access to and use of BrackHub ("Service"), operated by Harlikin Group Pty Ltd ABN [YOUR ABN], a company incorporated in Australia, trading as BrackHub ("we", "us", or "our").
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
2. The Service
BrackHub is an online sports bracket prediction platform that allows users to create and join prediction leagues, submit picks for sporting tournaments, and compete against other users on a leaderboard.
We offer both free and paid subscription tiers. Certain features are available exclusively to Pro subscribers.
3. Accounts
You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information when registering and to keep your account information up to date. We reserve the right to suspend or terminate accounts that provide false information.
4. Subscriptions and Billing
BrackHub offers the following subscription tiers. Fees are charged in Australian Dollars (AUD) unless otherwise stated.
- Free — no charge. Access to public free leagues.
- Amateur — $15 per year. Adds the ability to create one private league per tournament and to join private leagues.
- Pro — $45 per year or $6 per month. Adds unlimited private leagues, access to public Pro leagues with prize money, referral bonus entries, and AI matchup research.
4.1 Renewal and cancellation
- Subscriptions renew automatically at the end of each billing period until cancelled.
- Cancellation requires 30 days' notice. Where your next billing date falls within that notice period, that billing cycle will still be charged and your access continues until the end of the period so charged.
- Charges already made are not refunded or pro-rated, whether the subscription is monthly or annual, except where a refund is required under Australian Consumer Law.
- You may switch from Pro monthly to Pro annual at any time. The change takes effect at the end of your current monthly period — the annual fee is charged on that date and the annual term runs from it. You are not charged for both plans at once.
- Upgrading from Amateur to Pro takes effect immediately, and the unused portion of your Amateur term is credited against the Pro fee.
- Downgrading does not delete leagues you have already created; it only limits the creation of new ones.
- We reserve the right to change subscription pricing with 30 days' notice.
All payments are processed securely by Stripe. We do not store your payment card details. By subscribing, you also agree to Stripe's terms of service.
5. Prize Money and Competitions
Certain leagues may offer prize money. Prize money is funded by the league organiser and distributed at their discretion in accordance with the league rules stated at the time of entry.
BrackHub is a prediction game based on skill. It is not a form of gambling. Users predict sporting outcomes — no money is wagered on individual picks. Prizes in private leagues are provided by the league organiser, not by BrackHub.
5.1 Minimum entries for public Pro league prizes
Prize pools advertised in public Pro leagues are conditional on a minimum of 30 entries being received in that league.
- Where fewer than 30 entries are received, BrackHub reserves the right to adjust the prize pool, including its total value and how it is distributed, in line with the number of entries actually received. Such adjustments are made at BrackHub's sole discretion.
- Any adjustment will be announced to all users who have entered that league before prizes are awarded.
- For the purposes of this clause, each entry counts separately, including bonus entries held by the same user.
- This clause applies only to public Pro leagues operated by BrackHub. It does not apply to prizes offered in private leagues, which remain the responsibility of the organiser of that league.
You are responsible for understanding and complying with any tax obligations that may arise from receiving prize money in your jurisdiction.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Create multiple accounts to gain an unfair advantage in competitions.
- Attempt to manipulate scores, rankings, or pick deadlines.
- Share your account with others or allow others to submit picks on your behalf.
- Use automated tools, bots, or scripts to interact with the Service.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
We reserve the right to disqualify users from competitions, remove prize eligibility, or terminate accounts found to be in breach of these rules.
7. Intellectual Property
All content, branding, and software comprising the Service is owned by or licensed to us. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.
You retain ownership of any content you submit (such as league names or descriptions) but grant us a licence to display and use that content in connection with operating the Service.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that tournament results or scores will always be accurate in real time.
Sporting results used in the Service are sourced from publicly available data. We are not affiliated with any sporting body, tournament organiser, or broadcaster.
9. Limitation of Liability
To the maximum extent permitted by Australian law, we will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service, including but not limited to loss of data, loss of revenue, or loss of prizes.
Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded by contract.
10. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify you by email or via an in-app notification at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
